UAE - Employee accused of raping woman in car

Couple also accused of consensual kissing; woman defendant fails to show up in court
    
Dubai: An Emirati employee has been accused of kidnapping a woman and later raping her in his car in a remote area.

Prosecutors also charged the Emirati, S.I., with exchanging consensual kisses with the Indian woman, A.S., whom he was accused of abducting and raping.

Prosecution records said the 25-year-old woman is a purported victim as well as a defendant. The couple exchanged kisses before S.I. tried to have sex with her on June 31.

Records said A.S. convinced S.I. to abstain from having sex with her, according to records.


The Emirati suspect was then said to have taken her in his car to drop her home, but changed route and raped her in a remote area.

The defendant pleaded not guilty when he defended himself before the Dubai Court of First Instance.

“That did not happen,” said S.I. on Sunday.

Presiding judge Wajdi Al Menyawi was astonished while meting out the charges against S.I. The woman defendant failed to show up in court.

While addressing the bench of judges, the Emirati’s lawyer said, “This is very strange. We do not understand how our client can be accused of kidnapping and raping the woman when both were involved in exchanging kisses.”

The lawyer also drew the attention of court to his client who has been in detention for five months and asked the judge to release S.I. on bail.

According to the chargesheet, the employee kidnapped A.S. after convincing her that he will drive her home. On the way he threatened and raped her.

The Indian woman claimed that the incident happened a week after she met S.I. in front of the Foreign Ministry in Bur Dubai.

“When I asked him for directions to the American Consulate, he asked me for my name and contact details.

He called me later, but I refused to go out with him. He repeatedly called and sent me SMSs asking me to see him… Out of embarrassment I agreed to go out with him. We went out twice. On June 20, he picked me up and we went for a movie. We left at midnight and he claimed he wasn’t feeling well. Then he took me to his house. We stayed in a back bedroom… I refused his demand to lie on the bed. Then he started caressing and kissing me and I responded. When he started removing clothes and asked to have sex with me, I turned him down and resisted. Then he had sex with me in his car against my will,” A.S. told prosecutors.

Court records showed that the defendant had earlier been sentenced to six months for being involved in a similar case in 2004. The trial continues.
