The Kenya Bankers’ Association on Wednesday said 96 per cent of all Automated Teller Machines across the country have been upgraded to the Europay MasterCard and Visa (EMV) technology.
Bankers’ in April launched the Sh2.5 billion plan to migrate all members and their processes to the EMV standards with a deadline of September 30, 2013.
“We have achieved the set target and the remaining four per cent ATM’s have been earmarked for certification or phase-out before the end of the year,” said KBA chief executive, Mr Habil Olaka.
Payment cards that meet EMV standards are implanted with chip-and-PIN technology, which is considered more secure than the magnetic stripe cards that the banking sector is phase out.
In order to read these chip-and-PIN cards, banks have to modify ATMs and Point-of-Sale (POS) machines. Under the initiative, the 43 local banks ware to share the high costs of compliance with EMV standards.

Although the banking sector is well on its way to ensuring that all ATMs are EMV compliant, Mr Olaka said that a host of challenges have forced the sector to adopt a phased-out approach towards achieving compliance in other segments.

Behind Bundibugyo District Headquarters, next to the community conference Hall, is a unipot where Mzee Mulangira Iddi Mutaaka resides. I find the septuagenarian reading for beginning of term three exams. Mulangira was born to Adunga Likuta and Nkabadeda Evallet Nanseghiya in Tokwe village, Kakogha Parish, Bundibugyo District. He did not go to school until about the age of 16 when he was staying with his uncle, Joseph Muhindi, one of Kabaka Muteesa II’s servants who lived in Kitebi, Kampala. He used to sneak into the palace to play with princes Jjuko and Simbwa. It is because of his presence at the palace that some people mistook him for a Muganda thus the genesis of the name Mulangira (prince). While at the palace, he learnt Luganda and different cultural norms of the Baganda. However, Mulangira felt he had not achieved much from the palace because he was not a Muganda. This motivated him to start studying at Aggrey primary school in Bunamwaya. However, he dropped out shortly after.

Emirates expects to fly 70 million passengers in 2020, and the airline together with its partners in Dubai are already progressing on plans to ensure the right infrastructure are in place to support and capitalise on this growth.
Plans were unveiled by Emirates President Tim Clark yesterday at a presentation to delegates of Bureau International des Expositions
Dubai: Emirates expects to fly 70 million passengers in 2020, and the airline together with its partners in Dubai are already progressing on plans to ensure the right infrastructure are in place to support and capitalise on this growth.
These plans were unveiled by Emirates Airline President Tim Clark yesterday at a presentation to delegates of Bureau International des Expositions (BIE), who were visiting the UAE to make their final decision on the host city for the World Expo 2020. Dubai is a candidate city.
“By 2020, we will have more than 250 aircraft serving some 70 million passengers across six continents. It will make us the largest airline on the planet by international passenger traffic,” said Clark.
He added: “However, being the biggest airline in the world is not really the end goal. Our aim has always been to connect travellers from around the world to Dubai, and other destinations with just a single stop via our hub. The strategic location of Dubai makes it possible for us to serve almost 90% of the world’s population with non-stop flights, for example our 16-hour Dubai to Houston service on the Boeing 777-300ER, or our 14-hour Dubai to Sydney flight with the Airbus A380. Our location is a key advantage. The leaders of Dubai recognised this from the onset, and that is why Emirates is investing in the most advanced long-haul aircraft, and why Dubai has invested over the years to develop its infrastructure for international commerce and tourism.”
A catalyst for globalisation
Over a third of the world’s population lives within a 4-hour flight from Dubai, and two-thirds are within an 8-hour flight. Today, Emirates operates nearly 3,200 flights globally per week to 135 destinations in 76 countries. Since January 2012, it has launched new services to 20 destinations, adding air transport connections that will benefit trade and tourism to Dubai and beyond.
“Having the right equipment is important to our business model, but equally key to the mix is having the right ‘software’ – people and culture. With 50,000 staff from over 160 nationalities, Emirates is one of the largest multicultural organisations in the world. What this means is that we have people with a truly global mindset, who thrive in a fast-paced complex world, and are ready to embrace differences to bring the best ideas to the table. This is important if we want to be successful as a global connector and global enabler for travel, business and culture,” said Clark.
Ready for the future
Emirates is currently the largest operator of Airbus A380s and Boeing 777s, with an order book for 53 and 64 more of each aircraft type respectively. By 2020, it will have over 250 aircraft in its all-wide body fleet.
“We plan for the long-term and these plans include working closely with our stakeholders in Dubai including Dubai Airports and the GCAA amongst others, to make sure the right infrastructure is in place to support our planned fleet and traffic growth. We collaborate on every aspect of operations, from technical things like air space and stand operations, to the customer experience such as terminal facilities and efficient processing at check-in. It is a partnership, guided by a clear and steady leadership that recognises aviation as a key economic driver, espouses open competition, and fosters a consensus-based approach to investment,” said Clark.
Visitor and traffic growth at Dubai International airport has grown tremendously in the past decade, with international passenger numbers virtually doubling from 24.8 million in 2005 to 47.2 million in 2010. Last year, the airport handled 57 million passengers from 225 destinations, travelling in on more than 140 airlines including Emirates.
In 2020, Dubai expects to welcome over 20 million visitors and airport infrastructure has been gearing up to meet this demand. It opened Terminal 3 dedicated to Emirates’ operations in 2008, and recently opened a new Concourse A for Emirates’ A380 operations. Emirates is the only airline in the world today that operates an A380 dedicated terminal.
Work is also underway at Dubai International airport on a Concourse D to expand handling capability for the other airlines operating international flights, due for completion in 2015.
Al Maktoum International Airport at Dubai World Central (DWC), which started freighter operations in June 2013, will welcome its first passenger flights on 27 October. Emirates is constructing a new home for its freighter operations at DWC with a cargo terminal and supporting infrastructure, scheduled for completion in May 2014. By the mid-2020s, Al Maktoum International Airport will have the capacity to handle 160 million passengers and 12 million tonnes of cargo.

RWANDA - Chinese investors eye textile industry

A group of investors from China’s Zhenjiang Province has expressed interest in establishing light manufacturing plants in Rwanda to produce textiles.
Although the date and investment monies are yet to be disclosed, the group of 20 Chinese investors met Rwandan government officials yesterday to discuss available opportunities and incentives.
The team also included top Chinese experts.
The head of the delegation, Justin Yifu Lin, a former chief economist and Senior Vice president at the World Bank, now a professor of Economics at University of Peking, China, said at a media briefing that investors want to tap into Rwanda’s labor force by creating factories that provide employment to thousands.
“Every country needs to give leverage to what they have in abundance. Rwanda has a large and growing labour force which is trained but no marching jobs. What the investors from China want is to create profitable light factories that will manufacture products like socks, ties and clothes,” Lin said.
Helen Hai, an expert on China-Africa Investments, said that they were impressed by what Rwanda had implemented to facilitate investments, giving acclaim to existing business friendly procedures and steady infrastructural development.
“There is potential in Rwanda and what we want is a win-win situation. We have learnt about Rwanda’s tax policies and liberal trade values. We are going to discuss and proceed with investing,” she said.
Welcoming the development, Clare Akamanzi, the Chief Operations Officer of RDB, said trade between Rwanda and China is still relatively small but has potential to grow.
“What the Chinese investors are targeting is a reduced cost of production. We agreed that they begin with manufacturing light products such as socks and ties, which in effect will offer employment to many Rwandans,” Akamanzi said.
Rwanda has witnessed increased Chinese investment over the last five years, with over US$219 million invested in sectors like construction, tourism and agriculture.
Some notable investments include two five star hotels; the US$162 million Eagle on the Lake Hotel on the banks of Lake Muhazi in the Eastern Province and US$67 million Marriot Hotel in Kigali.
Star Media Africa, a pay tv company with presence in Rwanda, is also a Chinese investiment.

Kenya wants uniform mining regulations for East Africa

Kenya is lobbying to have a uniform legal and fiscal regulatory framework for the region’s mining sector as the country eyes more revenues from its natural resources.
Addressing the 3rd edition of the Mining Business and Investment Conference in Nairobi last week, mining cabinet secretary Najib Balala said that he will use his position as the chairman of the Southern and Eastern Africa Mineral Centre (SEAMIC) to push for the proposed reforms.
The country will also be seeking to have all African countries apply a uniform rate for royalties, a move that Mr Balala said will prevent mining companies from hopping from one country to another in search for cheap exploitative royalties.
“We must benefit from our minerals. I am going round Africa to lobby that all African governments should have one legal framework and royalties so that mining companies do not run from one country to another, just seeking low royalty rates which basically means exploiting those countries,” Mr Balala said.
SEAMIC is established under the United Nations Economic Commission for Africa and it acts as a centre for information for the region’s mining industry providing technical assistance, research and development, training and analytic services for members.
Mr Balala was appointed chairman of SEAMIC mid this year, a position that put him at the centre of mining activities in the region.
PUSH FOR UNIFORMITY
The push for uniformity in both the legal and fiscal frameworks guiding the region’s mining industry comes at a time when Kenya, like some other regional countries, is undertaking a review of the mining law to address emerging issues in the sector.
The Mining Bill 2013 that seeks to update the current Mining Act which dates back to 1940 proposes, among other things, an increase in the royalty rates from the current 3 per cent to as high as 12 per cent for precious minerals such as diamond.
The rates, according to the draft law, are to be charged on the gross value of minerals.
The proposal has already received criticism from the Kenya Chamber of Mines, a lobby group representing mining companies, saying that “it fails to take into consideration costs associated with the mining process.”
SECTOR EARNINGS
The lobby group is proposing to have 5 per cent charged as royalty on diamond and between 3 and 7 per cent to be applied on rare earth metals, against a proposal by the Ministry of Mining to have a royalty of 10 per cent charged on rare earth metals.
“In determining royalty rates and licensing fees, the government must take into consideration the impact on the country’s competitiveness and attractiveness to both local and foreign investors. The proposed royalty rates are out of sync with international best practice,” said Adiel Gitari, Kenya Chamber of Mines chairman in a statement.
According to the Kenya National Bureau of Statistics, the mining sector contributes about 0.8 per cent to the Gross Domestic Product very year.
Earnings from the sector grew from Sh18.3 billion in 2011 to Sh27.5 billion last year, according to the Economic Survey 2013, mainly due to increases in the value of gold and soda ash during the period.
This is despite the fact that Kenya is endowed with valuable minerals with the potential to fetch the country billions in annual revenue.
The Bill also seeks to establish the National Mining Corporation, an investment arm of the government in the mining sector.
It will hold interests on behalf of the government in mining companies.

Nokia launches first tablet, phablet phones

ABU DHABI,
Nokia, whose handset division is to be acquired by Microsoft, launched its first-ever tablet computer in Abu Dhabi on Tuesday, aiming for a stake in a fast expanding sector.
The Windows 10-inch screen tablet, Lumia 2520, was one of six new devices unveiled in the Emirati capital, including two so-called "phablets" -- large screen smartphones.
The Nokia Lumia 2520, available in red and white in a glossy finish as well as cyan and black in matte, is to go on sale in the United States at an estimated price of $499 by the end of the year.
"Initial roll out is to begin broadly in the US as well as the UK and Finland, with additional countries to follow shortly after," the company said in a statement.
"The award-winning design, the breakthrough imaging innovation, and the new experiences that we have brought to you with the Lumia smartphones we are bringing them to the tablet," Stephen Elop, executive vice president at Nokia Devices & Services, told reporters.
The device has a 6.7 MegaPixel camera and Zeiss optics.
PLAYING CATCH UP
Later on Tuesday in San Francisco, Apple was expected to show off slick new iPads to take on rival tablet makers in the run-up to end-of-year holidays.
Industry tracker Gartner this week forecast that global tablet shipments will reach 184 million units this year, in a massive 53.4 percent rise from last year.
The Nokia phablets, Lumia 1520 and a less-expensive Lumia 1320, have a six-inch screen.
The Nokia Lumia 1520 "delivers a brilliant image experience," said Elop. "It has optical image stabilisation. It has the latest technology to capture more details in every picture you take."
The Lumia 1520, available in yellow, white, black and glossy red, will first be released in the United States, Hong Kong, China, Singapore as well as European markets with an estimated price of $749.
The 1320 version, to be available in orange, yellow, white, and black, will sell for around $339 and first go sale in China and Vietnam, followed by other Asian markets and Europe.
Three new low-cost smartphones -- Nokia Asha 500, Asha 502 and Asha 503 -- are mainly targeted at developing markets in Asia and Africa.
The Asha 503, which includes a five MegaPixel camera and comes with a dual SIM option, is most expensive among the three costing around $99.
DEVICES AND SERVICES
Microsoft, which is trying to refocus the company around "devices and services" after missing out on the transition to mobile computing, announced in September it will buy Nokia's mobile phone division.
The deal worth $7.2 billion gives Microsoft Nokia's mobile phone operations along with an array of patents and licenses to help compete with rivals Google and Apple, as well as Samsung.
Nokia pioneered the mobile phone and dominated the market for 14 years, until it was overtaken by South Korea's Samsung in 2012 as the top-selling brand.
The company, long the pride of Finland, was blindsided by the shift to smartphones and struggled to fight off increasing competition from Apple's iPhone and Samsung's Galaxy.
PARTNERSHIP WITH MICROSOFT
Microsoft and Nokia have been partnered since 2011, co-creating Nokia's Lumia line of smartphones using Microsoft's Windows Phone software.
A Nokia distributor in Portugal, Agnieszka Loureiro-Pelc, told AFP that the deal with Microsoft "will definitely be a boost for the new development of Nokia."
Despite strong competition, "recent months have shown that the last Lumia products are quite strong and able to face the competitors," said Loureiro-Pelc, managing director at Azinor group.

TANZANIA - Fourth licensing round for oil and gas to open in Dar

Dar es Salaam. Tanzania has arranged an oil and gas exploration 4th licensing round, the first of its kind to be held in the country.
Through the licensing round to be launched on October 25, the government plans to offer seven blocks sitting in the deep offshore and a block in the Lake Tanganyika North.
According to Tanzania Petroleum Development Corporation the bid documents will be sold after the launch at the proposed price of $750,000 (Sh1.2 billion) per set.
“We are very happy to conduct the licensing round for the first time at home. It will help to increase awareness to locals on the oil and gas industry; it will also benefit different economic sectors in the country,” said TPDC principal petroleum geologist, Wellington Hudson.
The licensing round also will market Tanzania internationally which in turn will boost the country’s tourism sector.
The 4th licensing round is scheduled strategically just after the oil and gas conference on October 23 to 24.
The round will close in May 2014.
TPDC and ION Geoventures will organise a procedure of data purchase and payments for the purchase of bid document sets.
The previous three rounds were announced and held in London.
The first was opened in June 2000 and closed in April 2001, the second was held from June 2001 to July 2002 and the third round was opened in May 2004 and closed in May 2005.
“In the first round only one bid from Petrobras was received. They were awarded a Production Sharing Agreement for Block 5 in deep offshore,” said Dr Hudson.
The second round targeted 11 licensing blocks offshore Tanzania in water depths between 200 metres and 2000 metres, but only Shell International participated, winning four blocks.
The third round which targeted seven licensing blocks saw Ophir Energy win three blocks, Statoil two blocks and Petrobras one.
Pan African Energy, Maurel et Prom and Ndovu Resources has so far commenced the second part of exploration following the discovery of gas and condensate in the first phase.
In the 4th licensing round TPDC says it will give priority to bidding companies that will be partnering with Tanzanians.
Responding to a question by The Citizen, Dr Hudson said it requires an investor to have at least $150 million (Sh240 billion) to drill a 35 trillion feet well in deep offshore.

Dar es Salaam. Clients with the Tanzania Postal Bank (TPB) can now access financial services by using their mobile phones, thanks to a partnership between the financial entity and Airtel Tanzania.
Under the deal, which was signed in the city yesterday, TPB clients can now access financial services through Airtel Money. Cellular firm’s managing director Sunil Colaso, said in Dar es Salaam yesterday that the move seeks to help the company’s subscribers who are also TPB customers to access banking services hassle free.
“We target daily financial needs of Tanzanian consumers....Under this partnership, our customers who also bank with TPB across the country will enjoy easy banking services,” he said.
The integration between the bank’s system and Airtel Money allows customers to transfer funds from their bank accounts to their phones or transfer money from their bank accounts to business partners, friends or relatives’ accounts.
With over 20,000 Airtel Money agents countrywide, customers have a wider choice of how to access their money without necessarily relying on just Automated Teller Machines (ATMs).
According to the bank’s acting chief executive officer, Mr Jema Msuya, the agreement with Airtel reinforces the bank’s commitment to extend financial inclusion in the country. It also gives the financial entity a chance to serve the firm’s customers with other services.
“These other services include balance inquiry from your account, mini statement and bank transfers,” he said.
To access the service, customers need to dial *150*21# and follow the instructions, according to Airtel Money Operation manager John Ndunguru.“We completely assure you that transactions are safe, secure and will occur in real time,” he said.
Airtel Money is protected through a state-of-the-art security application.
It provides a bouquet of services that are not limited but include payment of bills for such utilities as electricity, pay-TV and water.

TANZANIA - LAAC urges Urambo council to put house in order

THE Parliamentary Local Authorities Accounts Committee (LAAC) has directed the Urambo District Council to put its financial records in order which includes payment of all outstanding debts amounting to more than 400m/-.
LAAC Chairman, Mr Rajab Mohamed Mbarouk (MP - Ole - CUF) also directed the Council to ensure more than 1bn/- meant for, women, youth and village development fund was allocated for the intended purposes within this financial year.
Mr Mbarouk noted that Urambo council failed to remit workers' salary contributions amounting to more than 138m/- to the Local Authority Pension Fund (LAPF), Teachers salary arrears amounting to 287m/- and ghost salaries of 13.8m/.
He said judging from the council's financial reports, it is clear the councils' capacity to operate is only 15 per cent, which is even lower than the previously recorded 17 per cent in the past two years.
"The committee directs Urambo council to come up with a regional strategy to identify and improve sources of revenue collection to ensure that more is collected," he explained.
He also directed the District Council Ethics Committee to follow up on those responsible for delays in remitting salary contributions to LAPF and accord befitting disciplinary actions.
Mr Mbarouk asked treasure representatives present during the meeting, to ensure teachers' claims were addressed with immediate effect.
During discussions, the council's Chairman, Mr Elia Kafwemba, revealed that the council still faced an acute shortage of manpower, especially teachers, health officers among others.
LAAC Chairman asked the Regional Administration and Local Government Authority (RALG) to liaise with the Public Service authorities under President's office to ensure that the council was authorized to employ more staff.
"The fact that the Parliament recently passed a law giving powers to councils to hire new staff members, the public service office should ensure that Urambo council receives written guidelines on how to go about this ..," he explained.
Citing an example on funds meant for women (5 per cent), youth (5 per cent) groups as well as villages (20 per cent), LAAC Chairman said the council has only managed to remit 600,000/-, out of 12m/- that was allocated for Women, Youth and Village Fund.
"We want to see that money meant for these groups channeled to them, failure to do so, next time we meet again, we will throw you out," he explained.

TANZANIA - Legal wrangle rages over gold scam
A MINING firm, Germany Connections Company Limited, has taken to court four persons, including KLM Royal Dutch Airlines, for alleged involvement in fraud transactions involving shipment of gold bars worth 1,998,000 US dollars from Tanzania to Dubai in the United Arab Emirates (UAE).
Other defendants in the matter filed at the High Court in Dar es Salaam are SJM Gems International Limited and its alleged Chief Executive Officer, Juma S. Juma and one Mike Mwombeki, who trades as Sizya Worldwide Enterprises.
The case came for mention before Judge Augustine Shangwa on Monday and has been set for another mention on November 22, so that the defendants can be served with the plaint of the suit. In the suit, Germany Connections Company Limited demands payments of 740,000 US dollars as the principal sum.
Through Makoa Law Chambers (Advocates), the Germany Connection Company (plaintiff) also requests orders for punitive damages of 300,000 US dollars, payment of general damages to be assessed by the court and several other payments of interests at court rate and costs of the suit.
The plaintiff alleges in the plaint of the suit that the defendants defrauded him in various ways, where SJM Gems International and Mr Juma are claimed to have promised to supply 50kg of gold knowing they have no such capacity.
It is alleged that the two defendants also supplied documents for insurance cover from Niko Insurance Limited for the consignment and that they issued other papers showing particulars for shipment given by the KLM Airlines, which were later doctored and provided particulars differing from time to time.
“The third defendant (KLM Airlines) did issue a letter to the plaintiff trying to justify the transaction and conducts of its officials at Mwalimu J.K. Nyerere International Airport in relation to the subject matter herein,” part of plaint of the suit reads.
It is claimed further that Mike Mwombeki, who trades as Sizya Worldwide Enterprises issued an invoice dated February 23, 2012 to the plaintiff, while the same had never offered their services to him.
The plaintiff alleges that sometime in February 2012, the parties entered into contractual arrangements under carriage, insurance and freight international trading arrangement terms whereby it was agreed that the plaintiff would purchase 54kg of gold bars valued at 37,000 US dollars each.
According to the plaint of the suit, the defendants were supposed to deliver the consignment to the final destination to the plaintiff in Dubai City. It is alleged that the defendants issued to the plaintiff an invoice for a total of 1,998,000 US dollars for the whole consignment.
It is further stated in the plaint that the advanced amount payable to the defendants before delivery of the consignment was 500,000 US dollars, which was supposed to be remitted to the SJM Gems International Limited bank account at Standard Chartered Bank Tanzania Limited.
The plaintiff allegedly paid the defendants 740,000 US dollars as purchase price of 20kg of gold and it was further agreed that payment of the remaining 34kg of gold bar amounting to 1,258,000 US dollars was to be paid to the defendants after the gold is delivered at the agreed destination.
On February 23, last year, it is claimed that SJM Gems International Limited through Mr Juma purported to have exported the said consignment to the agreed final destination, whereby the plaintiff was asked to take delivery thereto on February 26, last year.
After presentation of transport documents, the plaintiff was allegedly informed that the cargo was not gold but rough stones and the documents were not the same as the ones presented to him by the defendant for delivery purposes and that the export was named as Sizya Worldwide Enterprises.

Surging demand to strengthen the shilling - TANZANIA
The shilling is expected to gain this week, pushed up by increasing demand for the local currency to meet some month end obligations by corporate firms, leaving the dollar trading at a relatively low note.
The Standard Chartered Bank Daily Market Commentary said in its market report yesterday that the increased demand for the shilling was expected to continue, coupled with low to medium market volatility.
Similarly, the Barclays Bank market report showed that the fulfillment of local obligations by key players in the market during the week would boost demand for the local currency.
The bank said that the dollar fell to eight-and-a-half-month lows against the euro and a basket of currencies on expectations that the US Federal Reserve may delay scaling back its monetary stimulus following this month's political battles over the budget.
Analysts say concerns over the negative impact on the US economy and the likelihood of the Fed would leave its bond buying programme intact until well into next year would weigh on the dollar.

TANZANIA - Firm out to nab Windhoek Beer smugglers
MABIBO Beer Wine and Spirit Limited has launched a special operation in Dar es Salaam to identify locations and book all businessmen selling smuggled Windhoek Premium Lager Beer which do not contain unique company’s marks, notably the extraordinary MB66 mark.
The beer brand for the company indicates, in addition with MB66 Mark, that Mabibo Beer Wine and Spirit Limited is the sole distributor of Windhoek, which is brewed by Namibia Breweries Limited (NBL) in Tanzania.
“This time around no one will be spared. We have been so lenient in the past and those who are thinking that we are joking they feel it hot,” the company’s legal advisor and security, Advocate Stephano Kamala, told the ‘Sunday News’.
The company plans to take serious measures against those who will be found in possession of Windhoek not bearing the said company’s marks.
Mr Kamala reiterated the company’s call that all people in possession of the beer brands while knowing that they obtained from unscrupulous people without having MB66 mark, should forthwith surrender them to the nearest police station or to Mabibo’s offices and would be given genuine products.
He pointed out that the crackdown operation will go in juxtaposition of taking the culprits to court where they would be criminally held responsible upon failure to adhere to police slogan of respecting the law without being forced.
Already two people have been named and arraigned at the Kisutu Resident Magistrate’s Court for allegedly infringement of exclusive rights of Mabibo Beer Wine and Spirit Limited (Mabibo), by trading several cartons of the beer brand valued at over 107m/-.
They are Ambere Mwaseba (38) and Sebastian Kavishe (45), who are charged with infringement of exclusive rights, contrary to Section 31 and 32 (1) (a) (ii) and (b) and 9 of Trade and Service Trade Marks Act. He said that under Registered User Agreement registered in Tanzania under Trade and Service Mark Act, Mabibo Beer Wine and Spirit Limited is the sole importer and distributor of the beer brand in the country and such right was confirmed by Kinondoni District Court in 2010.
In the decree issued by Resident Magistrate Sudi Fimbo on October 15, 2010, the court declared, among others, that nobody is allowed to sell in Tanzania market Windhoek beer, which does not bear code number MB66, except where specific written consent of Mabibo has been sought and obtained.
“It is ordered that the defendant, its owners, agents, directors, servants and other unknown persons who are directly or indirectly related to the defendant, be permanently restrained from importing Windhoek Premium Large beer where they have not formally applied and obtained written consent of Mabibo.”
The court warned that failure or refusal by the defendant, its owners, agents, directors, servants and other unknown persons who are directly or indirectly related to the defendant or any other persons, to comply with the prohibition orders shall amount to contempt of the orders of this court.
In July, this year at a press conference, the International Independent Consultant with Mabibo, Mr James Rugemalira, named Land Mark Hotel as among involving in smuggling of Windhoek Premium Lager Beer in the country.
He claimed that on May 8, this year, the police from special zone in Dar es Salaam inspected the hotel premises at Ubungo area and found some bottles of Windhoek Premium Lager Beer which do not bear Code Number MB66, that is imported by Mabibo.

Tanzania Prime Minister urges speed on iron plants

PRIME Minister Mizengo Pinda has called on the China-based Hongda Group to make sure construction of iron ore and core plants in Mchuchuma and Liganga in Mbeya Region are completed on time as their completion is expected to boost the local economy.
The Premier, who is on official tour in the Asian superpower said at the weekend that apart from ensuring power independency, the projects were also geared to contributing largely to the nation’s Gross Domestic Products (GDP) as well as creating thousands of employment opportunities.
“Do whatever is in your capacity so that the projects can start within the agreed time and schedule as the country anticipates seeing big results from its implementation,” he said.
According to Hongda Group which has won the tender to construct the plants, the two major projects expected to be completed by 2017 and 2018 are jointly implemented by his company in collaboration with the National Development Corporation (NDC).
The Company’s Senior Officer Mr Liu Canglong told Prime Minister Pinda that the project was now in different phases of implementation including undertaking the Environmental Impact Assessment (EIA) which has been concluded.
The conclusion of EIA will be followed by the purchases of machines ready for the job, he said. Mr Canglong briefed the Premier that his company was receiving maximum cooperation from Tanzania and China ahead of the project take off and that it had already formed the board and its management team to oversee the project implementation and other day to day tasks.
NDC’s Managing Director Mr Gideon Nassari said that the two projects were expecting to produce more than 600 MW to be injected into the national grid, and the digging of iron core will surely make Tanzania one of the three African countries leading in the manufacturing of the product.
Mr Pinda also made a visit to the Sichuan Province where he visited the pipe raw materials manufacturing plant also owned by Hongda Group. He cherished the brotherly relationship between Tanzania and China recalling the death of some Chinese experts who perished as they constructed the Tanzania and Zambia Railway. Earlier, the Chinese Ambassador to Tanzania Mr Lu Youqing said out of 69 Chinese who died during the railway construction, 36 were from Sichuan Province.

China and Electrcite de France SA (EDF) will construct two nuclear reactors at the Hinkley Point site in southwest England.
Britain has clinched a deal with France and China to build the UK’s first nuclear power station in 20 years, media reports say.
As per the deal, China and Electrcite de France SA (EDF) will construct two nuclear reactors at the Hinkley Point site in southwest England, which will be the first in the UK since the Sizewell B power station came on stream in 1995.
The nuclear reactors, once completed, will commence delivering energy to 7 million homes from 2023, and will also cut consumer fuel bills by more than £75 a year from 2030.
EDF will hold a 45 to 50 percent stake in the pressurized water reactors, while China General Nuclear Corporation (CGN) and China National Nuclear Corporation (CNNC) will hold a 30 to 40 percent combined share and Paris-based Areva, will have a 10 percent stake for giving consultation on the technology and design.
The consortium could build a second plant on the Sizewell site in Suffolk, which altogether will have the capacity to produce 7 percent of UK electricity under the 35-year contract.
This is the first contract the Conservative-led coalition government has struck in an attempt to attract £110 billion of investment into Britain’s outdated electricity industry by 2020.

KENYA - House to block 'unclean' ministries budgets

Ababu Namwamba, who chairs the Public Accounts Committee, said they would work with the public prosecutor, the anti-graft body and the Auditor General to block the ministries.
He said the committee would work with the Budget and Appropriations team and the other offices to help bring to book those who misuse public money.
Mr Namwamba said the team aims to speed up the scrutiny of reports by the Auditor General so that ministries and departments that cannot account for their allocations are questioned before their allocations for the next financial year are approved by the Budget Committee.
He spoke in meetings with the Lands ministry and State House to address queries raised by the Office of the Auditor General for the 2010/2011 financial year.
“Before we’re through with you, the Budget Committee will not clear your budget,” he told Lands Principal Secretary Mariamu el Maawy. “We’ll not stop at blocking your budget. We’ll go to the extent of prosecuting you.”
His statement was intended for all ministries and departments and was repeated at the meeting with the team from State House.
The morning meeting was postponed because State House Comptroller Lawrence Lenayapa had not given the explanations to the Auditor-General’s officers despite having sent them to the committee.
“Those departments that don’t clear their accounts with us, we’ll not clear your budgets. We want to be linked to the Director of Public Prosecution and the Ethics and Anti-Corruption Commission so that the issue of accountability is taken seriously,” said Mr Namwamba.
SPECIAL AUDIT OF THE JUDICIARY
PAC has ordered a special audit of the Judiciary after claims emerged that some Sh80 million had been spent in unclear circumstances.
The aim is to get the Ethics and Anti-Corruption involved fast so the Director of Public Prosecution can go after anybody found culpable rather than wait for the Auditor General to raise the query in his annual report.
PAC normally scrutinises the reports from about two years back and much of the queries have by that time been answered, making their job tedious but without the desired results.
With State House, for example, the Auditor General had raised queries about re-allocation of funds without authorisation, misallocation of expenditure of Sh55 million, expenditure without supporting documents, outstanding and outstanding imprests of Sh2.5 million.
Mr Lenayapa and his team were given one week to consult with the Auditor-General and report back to the committee.
With Lands, where the accounts for the former Nairobi Metropolitan Development ministry were being examined, there had been some outstanding imprests for Sh3.8 million.
These had already been settled, said Ms El Maawy.
“We’re now putting in place monthly recovery. We’re also talking to HR and Finance so that the recoveries are made from (employees’) salaries,” she added.
Mr Namwamba said from his experience as minister, civil servants ought to be asked to account for imprests as soon as they return from their travels.
“We have seen worse from other departments where imprests are in the books for donkey years. Some of them have been colleagues in this House,” he said.
